This Service Agreement/Terms and Conditions and Consents (the ”Agreement”) governs your use of the services of iDirect Test LLC, and its authorized agents (collectively referred to herein as “iDirect”). By engaging our services, you agree that you have read, understand and consent to this Agreement. iDirect is a testing program that enables individuals to select and purchase laboratory tests and products from iDirect Site and/or its testing partners. iDirect is a "Direct-Access Testing" ("DAT") provider. As a DAT provider, we arrange for the collection and analysis of your specimen (body fluids, blood, urine, saliva, hair, tissue etc.) directly with a contracted third -party clinic or lab collection facility(ies) from the list of locations on our Site and send the lab's test results directly - and confidentially to you.
You acknowledge you are 18 years of age or older and that you voluntarily request the laboratory tests and/or other services on your own behalf. You agree to provide us with accurate, current, and complete demographic information, including your name, gender, date of birth, and contact information.
You agree and understand that you are utilizing service coordination and result notification services offered by iDirect, and that the actual testing will be performed by a third-party laboratory or collection facility. You certify that you are providing informed consent to and authorize iDirectto arrange for one or more of these tests and services (including sexually transmitted diseases or infections including, but not limited to, HIV where applicable) for analysis. You are agreeing to provide general consent for laboratory testing and informed consent for HIV testing (if you selected HIV testing as a requested service). A separate consent form for HIV testing is not required (Texas Health and Safety Code Sections 81.105 and 81.106). You understand that iDirect is not acting as your doctor, there will be no doctor-patient relationship formed and that this does not replace treatment by a physician and that you assume complete and full responsibility to take appropriate action with regards to test results, up to and including consulting with a physician. In this regard, you do not and will not hold iDirect responsible for and absolve them for the services provided by them or third-party affiliates of any liability. Since we are a DAT provider and we are NOT physicians, iDirect and its agents. Employees, officers, managers, and members CANNOT make any recommendations to you as to the "type" of “test” you "should" have or "might" need or provide medical advice. While iDirect will attempt to keep all information on our Site up-to-date, our Site should not be considered error-free or as a source of all information on a particular topic. iDirect makes no warranties or representations as to the accuracy of the content of the Site, and assumes no responsibility for consequences relating directly or indirectly to any action or inaction you take based upon the information and/or materials on our Site. You assume the entire risk of loss in using our Site and materials contained in our Site.
Any specifications of products or services described or depicted on our Site are subject to change at any time without notice.
iDirect may, at any time, and from time to time, change this Agreement. Any changes to this Agreement will be effective immediately upon posting of the changed terms and conditions on our Site. You agree to review this Agreement periodically, and use of the Site following any such change constitutes your agreement to follow and be bound by this Agreement as changed.
You should be aware that when you visit iDirect’s Site, iDirect may collect certain information that does not identify you personally, but provides iDirect with usage data, such as, but not limited to, the number of visitors iDirect receives or what pages are visited most often. This data helps iDirect to analyze and improve the usefulness of the information iDirect provides on our Site.
Like most commercial website owners, iDirect may also use what is known as “cookie” technology. A “cookie” is an element of data that a website can send to your browser when you link to that website. It is not a computer program and has no ability to read data residing on your computer or instruct it to perform any step or function. By assigning a unique data element to each visitor, the website is able to recognize repeat users, track usage patterns and better serve you when you return to that site. The cookie does not extract other information about you, such as your name or address. Most browsers provide a simple procedure that will enable you to control whether you want to receive cookies by notifying you when a website is about to deposit a cookie file.
This Agreement is effective unless and until modified as noted above, or terminated, at any time, by iDirect. If, in the sole discretion of iDirect, you fail to comply with this Agreement, iDirect may terminate this Agreement without notice and deny you access to our Site and cancel any pending orders placed through our Site.
To receive your test results, you must register for a free account on our website https://www.idirecttest.com and you agree to iDirect’s terms of service and you will validate your identity (“iDirect Test Account”). Your test results can only be accessed after logging into your iDirect Test Account. iDirect adheres to and maintains, as appropriate, commercially reasonable security measures to protect your data, both during transmission and once iDirect receives it. iDirect will send unencrypted messages to you to notify you to log into your iDirect Test Account to access your results. You understand that electronic communication via text, email or other electronic means over internet may not be secure and there is a risk that unencrypted texts or emails may be accessed by someone other than you during transmission or while stored, or after delivery by someone with access to your device or to your email account. When you provide your phone number and/or email to iDirect, you acknowledge that you understand this risk and understand that iDirect has no control over who may have access to your e-mail or phone or the data contained therein or accessed via your email or phone. You consent that iDirect and its agents may leave a voice message for you at your designated telephone number to alert you regarding your test results.
It is solely your responsibility to promptly review and discuss your laboratory results with a physician. The tests and results you may receive are not intended to diagnose or treat disease and do not constitute the practice of medicine. As with medical testing of any nature, the potential for falsely elevated, lowered, positive or negative laboratory values is present. Test results may vary depending upon, but not limited to, your personal information such as age, gender, medications and intake of food or drink prior to testing. You agree that you will seek medical advice, care and treatment from your usual source for health care if you have questions or concern, have any symptoms of illness, or become ill. You acknowledge and agree that you are making an informed decision to use the iDirect services and you have been given all necessary and relevant information to make that decision.
In consideration of the services to be rendered, you assume full financial responsibility for the payment of said services and agree not to submit any request for reimbursement from any insurer or health plan such as Medicare, Medicaid or private health insurance plans or the like. You agree to provide us with an accurate and valid credit card and/or other digital payment information to process payment for services rendered. You agree you are the authorized card holder for this purchase. If the account is referred to an attorney or collection agency, the same person authorizes credit investigation and agrees to pay actual attorney’s fees and collection expenses.
We reserve the right to accept, refuse or cancel any orders placed through our Site without liability or justification. You may cancel an order within 14 days of placing your order so long as the cancellation is in writing andprior to sample/specimen being collected at collection or testing facilities. Any canceled orders shall be subject to a non-refundable cancellation fee of Twenty percent (20%) of the original payment amount. No refunds will be issued after the 14th day of your purchase or after sample collection has taken place prior to the 14th day. If you do not have your sample collected at one of our collection locations within Forty-five (45) days of your purchase date, your purchase will expire and all funds paid shall be forfeited to iDirect.
For the purchase of at-home collection kits or products, you have until 11:59pm CST on the day of your purchase to cancel your order to receive a refund. There is a non-refundable cancellation fee of $35 plus applicable shipping and handling fees after 12:00am CST of day of purchase for all at-home kits or products. No refunds will be issued after the 14th day of your purchase.

iDirect adheres to and maintains as appropriate commercially reasonable security measures to protect your data, both during transmission and once we receive it. When you enter sensitive information on our site, we encrypt the transmission of that information using secure socket layer technology (SSL). However, the storage and communication of data may never be completely secure. Thus, we do not guarantee that information that you transmit or otherwise supply to us, or any communications conducted on or through the Site, is or will be totally secure. We may disclose collected information to the proper authorities if we become subject to a subpoena or court order or if we are otherwise legally required to disclose such information. iDirect may also be required by Federal, State or local laws to disclose certain health information to public health agencies to report, prevent, or control disease, injury or disability. For example, certain positive test results require reporting to public health agencies in accordance with applicable state laws. You may or may not be notified of these disclosures. You have reviewed all the above and you have had an opportunity to have any questions answered that you may have.
IDIRECT AND ITS OFFICER, MANAGERS, MEMBERS, AGENTS AND EMPLOYEES DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES WITH REGARD TO THE INFORMATION, SERVICES AND MATERIALS CONTAINED ON THIS SITE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOUR USE OF THIS SITE IS AT YOUR OWN RISK. ACCESS TO THIS SITE MAY BE INTERRUPTED AND INFORMATION, SERVICES AND MATERIALS MAY NOT BE ERROR-FREE. You agree and hereby expressly forever release and discharges iDirect, its officers, members, managers, its agents and employees from any liability, claims, demands, injuries, damages, actions or causes of action. You agree to indemnify, defend and hold harmless iDirect, its agents, officers, employees, managers and members from any liability, loss, claim, suit, damage and expense (including reasonable attorney’s fees and expenses) related to (i) your violation of this Agreement; or (ii) your request for testing for a third party to whom you do not have the authority to request testing.
This Agreement shall be construed in accordance with the laws of the State of Texas. Any dispute between iDirect and you related to this Agreement shall be resolved exclusively by the state and federal courts of the State of Texas.
